Why We Must Avoid an Article V Constitutional Convention!!!
There has been a lot of talk and controversy recently about a solution to our current “Constitutional Crisis” by having a Constitutional Convention.
For those that don’t know, the possibility of a Constitutional Convention is enabled in Article V of our Constitution and provides two methods of amending the Constitution:
1. Congress can propose amendments and then submit them to the States for ratification; or
2. If two thirds of the States make application for a Constitutional Convention, the Congress can call a convention to propose amendments.
It is interesting to note that every one of the 27 current amendments to the Constitution, including the Bill of Rights, were completed using the first method above.
The current push by many, both liberals and conservatives, to hold an Article V convention actually started a long time ago. Not surprisingly, it was first promoted in 1963 by the Ford and the Rockefeller Foundations.
Today, the idea of a Constitutional Convention is being pushed by hundreds of progressive (Marxist) groups such as; the Alliance for Democracy, the Center for Media and Democracy, Code Pink, the Coffee Party USA, Democracy Unlimited, the Progressive Democrats of America, Sierra Club, Alliance for Progressive Values, Committees of Correspondence for Democracy and Socialism, Democratic Socialists of Central Ohio, Media Action Center, MoveOn.org, Occupy, SEIU, and hundreds more…
Other notable promoters of the idea are:
· Michael Farris, Esq., of “Convention of States” (COS), and author of the “parental rights” amendment which delegates power over children to the federal & state governments.
· Nick Dranias, Esq., of the Compact for America, Inc., whose “balanced budget” amendment imposes a new national sales or VAT tax on the American People (over and above the income tax).
· Mark Levin, Esq., - His “balanced budget” amendment legalizes the unconstitutional spending of Congress and does nothing to control the debt.
One has to ask, why do all these people, liberals and conservatives, want an Article V Convention? The answer is simple; to re-write the Constitution!
One of the Arguments I hear in favor of such a Convention is “the Constitutional Convention can’t rewrite the Constitution if the States don’t agree to it.” This isn’t true!
Only amendments require ratification by ¾ of the States (see Art. V). However, a new constitution would have its own method of ratification – it can be whatever the drafters want. Can a convention be stopped from proposing a new Constitution? No!
Once the delegates are duly appointed and assembled, they are acting under the inherent authority of “The People” to alter or abolish their form of government (Declaration of Independence, 2nd paragraph); and have the sovereign power to do whatever they want at the convention.
This is what happened at the Federal Convention of 1787 where we got our current Constitution! To believe otherwise is to deny reality and our real founding history.
For those of you who have not attended my full “Constitution as the Founders Understood It” class, or my recent series of 10 classes held in Hill County, this may seem to completely go against what you have been taught about the creation of our Constitution, but it is verifiable true history.
The truth is that when the current Constitution Convention was held under Article XIII of The Articles of Confederation, the Continental Congress resolved on February 21, 1787 (p 71-74) to call a convention to be held at Philadelphia “for the sole and express purpose of revising the Articles of Confederation.” It wasn’t to create a NEW Constitution!
The delegates who attended this convention were ONLY authorized to Amend the Articles of Confederation. However, when they arrived they were shown a completely NEW Constitution, authored predominantly by Alexander Hamilton and John Jay. The Rhode Island delegation and half the New York delegation left the convention at this point as they had not been authorized to create a new Constitution!
Those delegates who remained ignored their duty and submitted this new Constitution to the legislators of their states.
This is why we do not want another Constitutional Convention with promises that the people would NOT have their rights infringed! Several of the legislatures would not move forward without the guarantee that a Bill of Rights be included.
Of course, with few exceptions, almost all of our rights have been infringed upon over time using the “generic” language included in this new “Constitution for the United States.”
Many authorities now believe that the “generic” clauses in the Constitution, such as the general welfare clause and the commerce clause, used to justify most of the abuses of our rights, were intentionally placed there to allow the federal government to usurp power, corrupt our form of government, and impose a new “neo-feudal” system over the American people over time.
With the way our out-of-control government is currently being run, we know that there will be corrupt appointees from the states that have their own agenda and NO intention of protecting YOUR rights!
Most of their proposals and writings indicate that the primary purpose of holding another Constitutional Convention is to “fundamentally transform” our form of government and achieve their Marxist/Fascist goals without the people’s consent.
Therefore, we don’t want another Constitutional Convention. It could be the biggest mistake America has ever made. Why?
All of our problems, whether they be our massive unemployment, our national deficit, the devaluation of our dollar, the rise of a militarized police-state, illegal immigration, attacks on the 2nd Amendment, etc...are all symptoms of abuse.
The only means to fix these problems is to return to the fundamental principles this country was founded upon. Without an immediate response by people unwilling to consent to these many abuses, America will shortly find itself a third-world nation, with no rights, enslaved by our own lack of action!
